Formal conditions of our future photoshoot

Amount and procedure of payment.

The total cost of rendering the Services shall be fixed at the time of conclusion of the Contract.
The Client shall pay to the Photographer a security deposit of 50 euros, which shall be taken into account in the final settlement. The Security Deposit shall be a guarantee for the Photographer to reserve the date of the order.
Photographer accepts payment by bank transfer, PayPal, cash.
Additional commissions of payment services and banks are paid by the Client.
On the day of the photo shoot the Client shall pay the Photographer the cost of the order less a deposit of 50 euros.
In case of non-payment of the balance of the purchased package, the Photographer reserves the right not to fulfill the terms and conditions of this Agreement, including the right not to hand over the photos to the Client until the full amount is paid by the Client, and the Photographer has the right to withhold the entire amount of the security Deposit as a penalty.
In the event that the start of the Photo Shoot is delayed by more than 10 minutes through no fault of the photographer, the photographer, at his/her discretion, shall have the right to change the final number of photos.
Time of moving around the city and possible downtime, meal breaks are included in the shooting hours.

Force Majeure, modification and termination of the Contract

In the exceptional event that the Photographer is in a state where he cannot fulfill his obligations under this Contract, the Photographer guarantees the full return of the Security Deposit.
Neither of the Parties shall be liable for failure to fulfill its obligations under this Contract in case of force majeure (force majeure), namely: serious illness, death, natural disasters, war and military actions of any nature, strikes, decisions of state authorities and governmental bodies, if they directly affected the fulfillment of the Parties' obligations under this Contract. In case of occurrence of these conditions and documentary confirmation of them, the Photographer shall be obliged to return the deposit to the Client in full, less commission fees.
In case of unilateral termination the Client is obliged to inform the Photographer in writing about the termination of the agreement not later than 15 calendar days before the date of the photo session. Otherwise, the Deposit shall not be refunded.
In case of cancellation, the client has the right to reschedule the photo session. The rescheduled photo shoot must take place within 30 days of the original date.
In case of rescheduling due to weather conditions, no additional fee will be charged.

Shooting, processing and transfer of photos

The Photographer undertakes to carry out the photography at a professional and technical level, as confirmed by the photographs in the Photographer’s portfolio and in accordance with the Photographer’s ideas about the style and level of intervention/non-interference in the events to be photographed.
The specific shots, moments, locations and angles, as well as the style of photography are at the discretion of the Photographer. The photographer conducts the photo shoot in harmony with his vision and perception. The Photographer shall take into account the Client’s personal wishes, if they do not contradict the moral and ethical views of the Photographer.
Photographer has the right to involve other persons — assistant, second photographer, videographer, retoucher — in the shooting at his own discretion, without prior notice to the Client, if the work of these persons does not incur additional expenses on the part of the Client.
The Client agrees that the quality of photos can be assessed only on a professional calibrated monitor or when printed in a professional photo lab.
The Photographer draws the Client’s attention to the fact that the processing of photographs does not provide for changing the sizes and colors of clothes of the people depicted in the photographs, changing the colors of cars, bouquets, interior items, etc., as well as changing the hairstyle, hair color, make-up elements and other details in the photographs using software. With this in mind, the Client should understand that the Photographer is not responsible for the work of stylists, make-up artists, hairdressers.
Photo processing includes light and color correction, which is at the discretion of the photographer.
When processing photos, the photographer does not change people in the photos, does not correct features of appearance and figure, does not “remove” unwanted objects or people in the photos. The amount of retouching of the photos is at the discretion of the photographer.
The source material in RAW JPEG format and any other format is the photographer’s working material and shall not be transferred to the Client.
The term of performance of the Service — transfer of the link to the online gallery is up to 30 calendar days from the date of the photo session.
The final series of photos may consist of: long shots, medium and close-up portraits, as well as shots that add atmosphere to the shoot — touch, hands, details, landscape, live blurred shots, etc.
*Photographs are transferred in the format of a link to a personal online gallery with the possibility of downloading in full size.
In case of illness or other unforeseen circumstances, the Photographer undertakes to notify the Client in writing no later than 5 days prior to the expiration of the deadline for fulfillment of obligations, about the delay in the transfer of photos. Otherwise, the Client is entitled to a compensation of 20% of the cost of the photo session

Preservation of photos

Photographer is obliged to ensure the safety of the footage within 1 month from the date of fulfillment of obligations under the Agreement — transfer of the link to the online gallery.
The Client is responsible for creating a backup copy of all photos from the online gallery.

Copyright and terms of use of the footage

The photographer has all copyright and property rights to the photos and reserves the right to use them for advertising his own services (for his demonstration portfolio in social networks, in publications of his own advertising and on his own website).
If the Client publishes the received photo material in mass media (advertising, internet, printed publications), the indication of the author of the photos — photographer is obligatory.
The Client acquires photos for personal use only and has no right to use them for commercial purposes and/or transfer the rights of commercial use to third parties.
At the Client’s request, he has the right to buy out the copyrights to the footage, which is secured by signing an agreement on the transfer of exclusive rights to photographic works. The cost of copyright transfer is 50% of the cost of this Contract and shall be paid separately.
